File # 2017-27885
Two members of the Nanaimo Police Dog Service were conducting training in the area of Labieux Rd and Leam Rd. One of the officers recognized a male as Kym ARKELL, a person that had outstanding warrants of arrest. When the officer approached him, the male produced a knife and threatened the officer, and ran towards Beban Park while the officer continued to follow him.
At the Kinsmen Participark sign in Beban Park, Mr. ARKELL turned and faced the officer with his knife out, and continued to threaten the officer and to cause himself harm. The second Police Dog Service handler was able to get around the male, and knock him onto the ground while his attention was drawn by the first officer.
The male would not drop the knife, and had it concealed under his body. He continued to refuse to follow the directions of the officers. As a result, further force was required to obtain the knife. Even after the knife was obtained, the male continued to resist the officers that were trying to arrest him. As a result of the arrest, the male suffered injuries requiring hospital treatment.
Police officers are authorized to utilize as much force as necessary to ensure the safety of the public and themselves. In this case lives were threatened with a weapon, and this danger does not pass until the weapon is removed and secured by police reported Corporal Jon STUART of the Nanaimo RCMP Detachment. The male was heading towards the Altrusa Playground at Beban Park with many children and families present. It was feared that there could be greater harm if he was allowed to enter the park area.
Kym ARKELL, a 32 year old resident of Nanaimo, has been charged with Assault with a Weapon, Uttering Threats, and Possession of a weapon. He has been remanded into custody, and will appear in court on Monday, August 28th.
